The normative dimensions of Internet use among patients and their families have not been studied in much depth in the field of clinical ethics. This study considers cancer-related Internet use among families and friends of cancer patients, and how that use of the Internet may affect patients and patient care. Interviews were conducted with 120 cancer patients, most of whom (76%) reported that family, friends, and others in their social network used the Internet in some way related to the patient’s (...) cancer. Many patients (73%) did not request this online help from their social networks, yet found it helpful and comforting nonetheless. Other patients were less positive about the helpfulness of the online efforts of friends and relatives. A significant proportion of patients (39%) also felt that the online information they received was prescreened or edited in some way. Very few patients recalled that their clinicians ever discussed these and other issues with them. The study illustrates that indirect Internet use is a central feature of the cancer experience. In contrast to other literature in this area, the study suggests that indirect Internet use may have normatively positive and negative implications for patients. These implications point towards the importance of studying and understanding indirect Internet use—and Internet use in general—in the field of clinical ethics. (shrink)

Extant literature on Goodman’s ‘New Riddle of Induction’ deals mainly with two versions. I consider both of them, starting from the (‘epistemic’) version of Goodman’s classic of 1954. It turns out that it belongs to the realm of applications of inductive logic, and that it can be resolved by admitting only significant evidence (as I call it) for confirmations of hypotheses. Sect. 1 prepares some ground for the argument. As much of it depends on the notion of evidential significance, this (...) concept is defined and its introduction motivated. Further, I introduce and explain the distinction between support and confirmation: put in a slogan, ‘confirmation is support by significant evidence’. The second section deals with the Riddle itself. I demonstrate that, given the provisions of the first section, not ‘anything confirms anything’: significant green-evidence confirms only green-hypotheses (and no grue-hypotheses), and significant grue-evidence confirms only grue-hypotheses (and no green-hypotheses), whichever terms we use for expressing these evidences or hypotheses. The third section rounds off my treatment. First I show that Frank Jackson’s use of his counterfactual condition is unsuccessful. Further, I argue that no unwanted consequences result, if one starts from the other, ‘objective’, definition of ‘grue’, as it constitutes no more than a mere fact of logic that cannot do any harm. Finally, I present a grue-case involving both kinds of definition, where the exclusive confirmation of either the green- or the grue-hypothesis is shown. (shrink)

Relaxed realists hold that there are deep differences between moral truths and the truths studied by the empirical sciences, but they deny that these differences raise troubling metaphysical or epistemological questions about moral truths. On this view, although features such as causal inefficacy, perceptual inaccessibility, and failure to figure in the best explanations of our empirical beliefs would raise pressing skeptical concerns were they claimed to characterize some aspect of physical reality, the same is not true when it comes to (...) the moral domain. This chapter raises some doubts about this general picture of morality and some prominent ways of defending it. First, it takes up a comparison that is frequently invoked by relaxed realists, and one on which they often place a great deal of weight: a comparison between irreducibly normative properties and truths on the one hand, and mathematical properties and truths on the other. It argues that this comparison is much less favorable to the relaxed realist’s cause than is often thought. It then offers an extended critique of a particularly vigorous and sustained presentation of relaxed realism: that offered by Ronald Dworkin in Justice for Hedgehogs. (shrink)

This book departs from much of the scholarship on Kant by demonstrating the centrality of imagination to Kant's philosophy as a whole. In Kant's works, human experience is simultaneously passive and active, thought and sensed, free and unfree: these dualisms are ofen thought of as unfortunate byproducts of his system. Gibbons, however, shows that imagination performs a vital function in 'bridging gaps' between the different elements of cognition and experience. Thus, the role imagination plays in Kant's works expresses his fundamental (...) insight into the complexity of cognition for finite rational beings such as ourselves. Gibbons begins with an interpretation of synthesis which shows it to be a broader activity than most accounts suggest. Examining the first Critique, she presents a reading of the Transcendental Deduction and the chapter on Schematism that spells out the extraconceptual activities of imagination essential to cognition. This account of imagination is built upon in the Critique of Judgment, where Kant elaborates its role in characterizing the subjective conditions of judgement. Throughout, the cooperation of imagination and reason is highlighted; Gibbons shows that on Kant's account, human beings pursue reason's ideal ends through the provisional and continuing attempt to articulate them. This attempt involves an appeal to a shared social and historical imagination - thus, a full characterization of the subjective conditions of judgement must include the role of imagination. (shrink)

To ensure accurate chromosome segregation during mitosis, the spindle checkpoint monitors chromosome alignment on the mitotic spindle. Indjeian and colleagues have investigated the precise role of the shugoshin 1 protein (Sgo1p) in this process in budding yeast.1 The Sgo proteins were originally identified as highly conserved proteins that protect cohesion at centromeres during the first meiotic division. Together with other recent findings,2 the study highlighted here has identified Sgo1 as a component that informs the mitotic spindle checkpoint when spindle tension (...) is perturbed. Collaboration requires agents to coordinate their behavior on the fly, sometimes cooperating to solve a single task together and other times dividing it up into sub‐tasks to work on in parallel. Underlying the human ability to collaborate is theory‐of‐mind (ToM), the ability to infer the hidden mental states that drive others to act. Here, we develop Bayesian Delegation, a decentralized multi‐agent learning mechanism with these abilities. Bayesian Delegation enables agents to rapidly infer the hidden intentions of others by inverse planning. (...) We test Bayesian Delegation in a suite of multi‐agent Markov decision processes inspired by cooking problems. On these tasks, agents with Bayesian Delegation coordinate both their high‐level plans (e.g., what sub‐task they should work on) and their low‐level actions (e.g., avoiding getting in each other's way). When matched with partners that act using the same algorithm, Bayesian Delegation outperforms alternatives. Bayesian Delegation is also a capable ad hoc collaborator and successfully coordinates with other agent types even in the absence of prior experience. Finally, in a behavioral experiment, we show that Bayesian Delegation makes inferences similar to human observers about the intent of others. Together, these results argue for the centrality of ToM for successful decentralized multi‐agent collaboration. (shrink)

Edmund Gettier (1963) argued that there can be justified true belief (JTB) that is not knowledge. I question the correctness of his argument by showing that Smith of Gettier’s famous examples does not earn justification for his incidentally true beliefs, while a doxastically more conscientious person S would come to hold justified but false beliefs. So, Gettier’s (and analogous) cases do not result in justified _and_ true belief. This is due to a tension between deductive closure of justification and evidential (...) support. For being justified, any believing, disbelieving, or withholding of deductively inferred propositions must be distributed proportionally to given evidential support. This proportionality principle has primacy over deductive closure in case of conflict. My argument does not save the JTB-account. But, instead of merely referring to an intuition, it explains why subjects in Gettier situations do not earn knowledge. (shrink)

Despite the extreme violence and severe overcrowding that plague U.S. prisons, prison reform is nearly a non-issue in this country. Immanuel Kant's Metaphysics of Morals may first appear an unlikely place to seek support for a more critical view of prison conditions and popular attitudes toward them. But by appeal to the doctrines of right and virtue, we can discover substantial Kantian grounds to support reform efforts.On Kantian bases I thus develop two principles, the first a principle of justice and (...) the second one of civic virtue. Together these standards, intermediate between the more general principles of Kant's moral theory and our concrete practical problems, can guide us in addressing interrelated issues of prison conditions and crime deterrence and in evaluating our own tendency to view convicts as somehow outside the ranks of humanity. While the principles of improvement and of civic respect cannot provide final answers to relevant reform issues, they can carry us a significant distance in identifying and understanding our weight moral responsibilities in this realm. Obwohl die US-Gefängnisse mit starker Überfüllung und extremer Gewalt zu kämpfen haben, ist eine Reform des Gefängniswesens in den Vereinigten Staaten nahezu kein Thema. Kants "Metaphysik der Sitten" mag zunächst nicht als ein Ort erscheinen, an dem man für eine Kritik an den Bedingungen in den Gefängnissen und an der allgemeinen Einstellung in der Bevölkerung dazu irgendeine Hilfe sucht. Bei näherem Hinschauen können wir jedoch in Kants Rechts- und Tugendlehre wesentliche Gesichtspunkte entdecken, die die Reformversuche unterstützen. In meinem Beitrag entwickle ich auf Kantischer Grundlage zwei Prinzipien, ein Prinzip der Gerechtigkeit und ein Prinzip bürgerlicher Tugend, Standards, die irgendwo zwischen den allgemeinen Prinzipien von Kants Moraltheorie und unseren konkreten praktischen Problemen stehen. Zusammen können uns diese beiden Standards eine Anleitung dafür geben, wie die miteinander verwobenen Themen a) der Bedingungen in den Gefängnissen und b) der Verbrechensabschreckung anzugehen sind und wie wir unsere eigene Neigung zu beurteilen haben, verurteilte Strafgefangene als mehr oder weniger außerhalb der Menschheit stehend anzusehen. Obwohl das Prinzip der Besserung und das der bürgerlichen Achtung, wie ich sie nenne, auf die einschlägigen Reformprobleme keine endgültigen Antworten geben können, können sie uns doch bei der Erkenntnis und beim Verstehen unserer nicht geringen moralischen Verantwortung in diesem Bereich einen großen Schritt weiterbringen. John Cottingham In the anglophone philosophical world, there has, for some time, been a curious relationship between the history of philosophy and contemporary philosophical - quiry. Many philosophers working today virtually ignore the history of their s- ject, apparently regarding it as an antiquarian pursuit with little relevance to their “cutting-edge” research. Conversely, there are historians of philosophy who seldom if ever concern themselves with the intricate technical debates that ll the journals devoted to modern analytic philosophy. Both sides are (...) surely the poorer for this strange bifurcation. For philosophy, like all parts of our intellectual culture, did not come into existence out of nowhere, but was shaped and nurtured by a long tradition; in uncovering the roots of that tradition we begin see current philoso- ical problems in a broader context and thereby enrich our understanding of their signi cance. This is surely part of the justi cation for the practice, in almost every university, of including elements from the history of philosophy as a basic part of the undergraduate curriculum. But understanding is enriched by looking forwards as well as backwards, which is why a good historian of philosophy will not just be c- cerned with uncovering ancient ideas, but will be constantly alert to how those ideas pre gure and anticipate later developments. This paper constitutes one extended argument, which touches on various topics of Critical Rationalism as it was initiated by Karl Popper and further developed in his aftermath. The result of the argument will be that critical rationalism either offers no solution to the problem of induction at all, or that it amounts, in the last resort, to a kind of Critical Rationalist Inductivism as it were, a version of what I call Good Old Induction. One may think of David Miller (...) as a contemporary representative of what I consider as the ‘no solution’ version of critical rationalism, while Alan Musgrave stands for the version of ‘critical rationalist induction’. The paper presents a subjectivist interpretation of Protagoras’ man-measure fragment, by explaining some key terms (‘all things’, ‘measure’, ‘man’) and reconstructing his ontological, epistemological and anthropological views. The argument uses other fragments and testimonies of Protagoras as well as intertextual allusions to previous authors (especially Anaxagoras) and instances of reception of Protagoras by Plato, Aristotle and Isocrates which are particularly used here for the first time in order to interpret the man-measure fragment. It is argued that Protagoras denied metaphysical speculation (...) and preferred human knowledge based on subjective perception and made plausible by intersubjective discourse. (shrink)

With the last Holocaust survivors quietly passing away, one might also expect to see accountability debates slowing to a trickle. Surprisingly, however, recent years show an upswing in corporate World War II-related atonement debates. Interest in corporate participation in mass atrocity has expanded worldwide; yet what constitutes ethical corporate behavior during and after war remains understudied. This article considers these questions through a study of the French National Railways’ roles during the German occupation and its more recent struggle to make (...) amends. This study demonstrates that ethical business leadership requires taking responsibility for past as well as current decisions. Most executives grappling with complex corporate histories work in isolation, in part because the scholarship on business ethics fails to provide guidance. Without such guidance, corporations often respond to accusations about their pasts with carefully crafted statements and legal strategies rather than deep expressions of moral leadership. To assist in remedying this tendency, this paper simultaneously encourages companies to engage in deeper reflection on corporate history, while urging scholars to help guide corporations through critical ethical conversations. This paper comprises a case study illustrating ethical and practical challenges for a Ugandan hospital-based social worker early in the COVID-19 pandemic, followed by a commentary. The hospital was under-resourced, with staff and patients experiencing lack of information and panic. The social worker, Denis Adia, recounts his responses to new and ethically challenging situations, including persuading Muslim patients to stop fasting for the good of their health; deciding to keep a baby in hospital with parents although this was against the (...) rules; and supporting a stigmatised former patient in the face of intimidation by colleagues. He reflects on the importance of recognising each person’s unique needs and circumstances, seeing this as a vital role for social workers. The case is followed by a commentary from a UK academic (Sarah Banks), who notes the cognitive and emotional effort (‘ethics work’) undertaken by the social worker to: see the ethical aspects of particular situations; take account of patients’ specific needs; ensure they are treated with respect; promote their well-being; and perform as a good social worker. Banks draws attention to the key role of the virtue of courage in pandemic conditions, which involves working with new risks and facing fears with confidence. (shrink)

In einer früheren Arbeit habe ich neben anderem auch Poppers Theorie der rationalen Präferabilität der bestbewährten Theorie kritisiert und festgestellt, daß sie weder als Theorie der theoretischen Rationalität (d.i. die Rationalität des bloßen, an keinem anderen Zweck als dem des an der wissenschaftlichen Neugierde orientierten Glaubens, Meinens oder Führwahrhaltens)noch als Theorie der praktischen Rationalität (d.i. die Rationalität der auch an sonstigen Zwecken orientierten Handlungen bzw. Handlungsentscheidungen)tauglich sei. Im wesentlichen habe ich argumentiert, daß es bei der Verfolgung des Zieles, sich der (...) Wahrheit anzunähern, um nichts rationaler sei, die jeweils bestbewährte Theorie zu präferieren als sie nicht zu präferieren (und anstelle dessen die Präferenz z.B. vom Ergebnis eines Münzwurfes abhängig zu machen). Allerdings habe ich im Rahmen dieser Kritik „rational“ mit „begründet“ i.S. von „gute Gründe haben“ gleichgesetzt (und ich halte dies auch nach wie vor für richtig). Da nun aber David Miller behauptet, daß Rationalität durchaus ohne Bezugnahme auf gute Gründe auskomme (abgesehen davon, daß gute Gründe gar nicht beizubringen und – selbst wenn es sie gäbe – völlig unnütz wären), werde ich meine Argumentation entsprechend erweitern. Presence is a central yet controversial topic in the study of performing arts and theatrical traditions, where the notion of ‘stage presence’ is generally understood as the performer’s ability to enchant the audience’s attention. How do dancers relate to the idea of presence in performance, and how do they understand, enact, and perform presence in their artistic work and practices? In this paper I offer an investigation into presence’s variations in three different dance practices and choreographic contexts: the case of (...) the Ballet National de Marseille during the staging of Emio Greco’s piece Passione; Contact Improvisation in the case of independent groups of contacters in Italy and Australia; and Body Weather, a radical movement ideology developed by Japanese choreographer Min Tanaka in the context of the company Tess de Quincey and Co. in Sydney. To illustrate how presence in dance practices emerges in relation to a complex and dynamic environment, I propose a cognitive ecological approach to the notion of ‘stage presence’, which considers both the co-presence of audiences and performers and the socio-cultural context of the performance event. By exploring how dancers articulate their lived experiences of presence in relation to their different dance contexts and traditions, I suggest framing phenomena of presence in an embodied ecological sense. School gardens and garden-based learning continue to gain great popularity in the United States, and their pedagogical potential, and ability to impact students’ fruit and vegetable consumption and activity levels have been well-documented. Less examined is their potential to be agents of food system reskilling and transformation. Though producer and consumer are inextricably linked in the food system, and deskilling of one directly influences the other, theorists often focus on production-centered and consumption-centered deskilling separately. However, in a school garden, the (...) production/consumption disconnect is erased, by virtue of the design of the site itself and how it is utilized by the actors within it. School gardens provide the critical component of education in alternative food networks, and contribute to the producer/consumer reskilling that is a necessary part of food system transformation. We conducted a case study of an established school garden program during its transition from autonomous non-profit to official, district-funded program of a rural school district in the Midwest. By participating in the full “seed to plate” life cycle of a garden crop, students in the garden were actively involved in the reconnection of producer and consumer, while educators were fostering in students an appreciation for fresh, healthy foods and actively challenging the “McDonaldization” of both students’ diets and education. Based upon these findings, we argue that school gardens in rural areas could leverage the dominant role of rural America in developing and shifting food system paradigms. (shrink)

The article argues that Frederick II of Hohenstaufen and his court played a unique role in the transfer and diffusion of Arabic science. Scientists at the court translated and elaborated upon it. Moreover, there existed a two-way traffic of scientific knowledge between Frederick and his court scholars, on the one hand, and several oriental courts and their scientists on the other hand. Thus the reader gains a view of Frederick's scientific activities from the Arab perspective, too.Frederick's contribution to the existing (...) biological sciences of his time was his “Book of Falconry”, which was exceptional in the then contemporary approach and methods employed in those fields. Even in this treatise on falconry, Frederick drew upon the fund of knowledge of Arab practitioners. This chain of arguments concerning Arabic science is situated within the setup of Frederick's oriental political practice and sumptuous court life. (shrink)

Abstrakt Der Artikel fragt nach der Rezeption von Platons Freundschafts- und Liebesbegriff bei Plotin. Zunächst wird gezeigt, dass Platons Liebestheorie im Symposion und im Phaidros gleichermaßen auf den Aufstieg zum Ideenhimmel und die Selbstvervollkommnung des Liebenden abzielt, wobei der Phaidros mit der Freundschaft als schwächerer, durch Reziprozität gekennzeichneter Form der Liebe die soziale Dimension des Aufstiegs und der Vervollkommnung thematisiert. Dann wird nachgezeichnet, inwiefern Plotins Liebes- und Freundschaftsbegriff Theorieelemente aus Platons Symposion und Phaidros fortentwickelt. Nach Plotin ist die Liebe das (...) Movens des Aufstiegs zum Einen und die Freundschaft das Movens des dazu komplementären Abstiegs zur Vielheit. Es wird schließlich gezeigt, dass Platon wie Plotin ausschließlich an der philosophischen Freundschaft und Liebe interessiert sind und diese zentral für ihr Konzept von Erziehung und Selbsterziehung sind. Starting from the question of whether Ernst Mach's well-known notion of "Elemente" (elements) must lead to the verdict that the arch-anti-metaphysician himself may be justly accused of holding an essantially metaphysical position, the idea of metaphysical neutrality is explained in Section I. Section II deals with Quine's verdict on abstract entities, among which Mach's elements would have to be counted if there were no way out of the Quinean test. Such a way out, it is proposed in section III, is (...) Carnap's Remedy: the distinction of external and internal questions. Finally, in Section IV, the empirical meaning of Mach's notion of elements is explained, from whence it's argued that Mach's "philosophy" is good, non-metaphysical, empirical science. (shrink)

Meinong befaßt sich darin zunächst mit der „objektiven" Wahrscheinlichkeit, die als Grade oder Abstufungen von Möglichkeit Objektiven in „unsubjektiver" Weise zukommt, und stellt ihr dann die eigentliche oder „Vermutungswahrscheinlichkeit" gegenüber, die in Meinongs Sinn insofern subjektiv ist, als sie in der Eigenschaft von Objektiven besteht, durch berechtigte Vermutungen erfaßt werden zu können.Meinongs Reihung folgend wird zunächst (...) die objektive, sodann die subjektive Theorie diskutiert. In his widely read earlier dissertation, "Treasury of names and poetic language," the author explained that the structural form of the two-part Germanic first name dates back to a distant Indo-German past. Thus, the Germanic examples (of the type "Wolfram," which means "wolf raven") emerge from composed designations of men in epic poetry, that is, from the poetic vocabulary for princes and warriors. He argues that the same is probably true for a much earlier treasury of names (one that goes (...) back to the 2nd millennium B.C.) as a specific legacy from the Indo-Aryan war chariot culture. From there, it went on to be disseminated to the rest of Indo-Germania, including the Celts and the Germanic peoples. In his new book, the author subjects his theory to testing, revision, and extension. Thus, the volume will be an indispensable resource for name researchers as well as academic experts in medieval and Nordic literature, and for students of the social history of the medieval world. The book situates the works and reception of the French scholar Pierre de la Ramée (Petrus Ramus) in a variety of European cultural and educational contexts, from Britain and France to Eastern Europe, from Germany to the Iberian peninsula, and from Scandinavia to the Netherlands. Pierre de la Ramée or Petrus Ramus (1515-1572) has long been a controversial figure in educational reform and innovation, from the moment of his first public academic statements in the 1530s, to his reception among scholars (...) in the twentieth and twenty-first centuries. What is beyond dispute, however, is the vast reach of his influence throughout Europe. Ramus's ideas were disseminated through copious editions and translations of his own textbooks, and in wave after wave of adaptations and re-imaginings of his ideas that swept across the continent. This volume embarks on a European tour of Ramism, using a wide range of previously unpublished or untranslated archival evidence from throughout the continent to examine the dissemination of Ramus's works and his intellectual influence in geographic and in disciplinary terms. The ten chapters explore the spread of Ramism from his home country of France to Protestant strongholds in Germany, Holland, and Britain, and in the Catholic context of the Iberian peninsula. The book also examines Ramism in the less familiar territories (to most Anglophone readers) of Scandinavia and Hungary, and considers the preceding and contemporary Dutch and German educational reform movements from which Ramus borrowed to forge his own distinctive intellectual method. The multiplicity of deubiquitinating enzymes (DUBs) encoded by vertebrate genomes is partly attributable to whole genome duplication events that occurred early in chordate evolution. By surveying the literature for the largest family of DUBs (the ubiquitin-specific proteases), extensive functional redundancy for duplicated genes has been confirmed as opposed to singletons. Dramatically conflicting results have been reported for loss of function studies conducted through RNA interference as opposed to inactivating mutations, but the contradictory findings can be reconciled by a recently proposed (...) compensatory mechanism involving nonsense-mediated RNA degradation. Duplicated genes are often inactivated to become pseudogenes, and it is proposed that such is the fate of the USP15 gene of zebrafish, a commonly used model system. As it is reviewed here, these observations have implications not only for the interpretation of model system phenotypes but also for therapeutic interventions designed to target DUBs. (shrink)

According to some philosophers, a sentence's semantics can fail to constitute a complete propositional content, imposing mere constraints on such a content. Recently, Daniel Harris has begun developing a formal constraint semantics. He claims that the semantic values of sentences constrain what speakers can literally say with them—and what hearers can know about what was said. Lex Luthor despises Superman. He obsesses about Superman. He tries to kill Superman. Luthor takes existentialism to the extreme, though, rejecting ethics and becoming an anti‐hero. In Superman: Secret Origin, Luthor is presented as self‐directed from an early age. Friedrich Nietzsche can help us understand Luthor as an iconoclast, literally one who breaks sacred images. Luthor also explains why he is so obsessed with bringing down Superman. Luthor thinks that Superman interferes with people viewing their lives as an existential project. (...) Lex Luthor underscores the complexities of existentialist philosophy. While he is creative, self‐determined, and autonomous, he is also completely immoral. His willingness to sacrifice anything or anyone takes existentialism to an extreme that Nietzsche, Sartre, and Kierkegaard would reject. And so, we are left to wonder: is Lex Luthor an evil genius and an abomination to existentialism, or might he be a true evolution of what existentialism can become. (shrink)

With attractive and scantily clad female characters, Zeus as a philandering womanizer, the First Born as a hyper‐masculine war monger, and Hera as a jealous wife blaming other women for her husband's infidelities, Wonder Woman (the New 52 series) confirms some age old stereotypes about men and women. But, Wonder Woman (the New 52) also challenges some traditional gender stereotypes. The end of the twentieth and beginning of the twenty‐first century have witnessed great strides in gender equality for, among others, (...) heterosexual women and members of the LGBTQ community. In one of the most important early books in twentieth‐century feminist philosophy, The Second Sex, philosopher and novelist Simone de Beauvoir explores women's inequality to men. In this article I describe my experience teaching a moral problems course to first-year students within a Learning Community model. I begin with the learning goals and the mechanics of both my Learning Community and my moral problems course. I then focus on the experiential learning requirement of my Learning Community which is based on a field trip model instead of a service learning model. I describe how two field trips in particular—one to an Arab American community in Brooklyn, New (...) York, and the other to a Black American community in West Harlem, New York—primed my students to more effectively engage in philosophical discussions about terrorism, war, and affirmative action. I conclude that experiential learning on a field trip model helped my students to have more sophisticated conversations about complex and emotionally charged moral issues. (shrink)

The aim of The Legal Foundations of Micro-Institutional Performance is to introduce the reader to a different way of thinking about economics that will allow them to both understand and apply legal concepts to economic analysis. To this end, it adopts and further develops Wesley Hohfeld's legal framework of jural (legal) relations as a tool of analysis. This analytical tool, as built into the Legal-Economic Performance framework, provides specific direction in identifying and describing interdependence among economic agents (including rights, duties, (...) liberties and exposure to various acts). The framework adopted and developed in this book relies on the concept of interdependence--that all economic agents are tied together in a legal system given the inherent interdependent nature of transactions in a complex modern global economy. The authors start by developing this framework and then apply it to a variety of settings and empirical examples. Using this new method, economists will be able to reshape their analysis to account for how legal systems and specific legal rules impact economic performance and outcomes. This approach will be of great interest to graduate and advanced undergraduate social science scholars, faculty interested in the intersections of law and economics and the application of legal concepts to impact analysis, and practitioners in the fields of policy, law and economics.
